Please read these Terms and Conditions ("Terms", "Terms and Conditions" “Agreement”) carefully before using the Sustainability Page website (the “Website” "Service" “Site”), an online sustainability page “Page” builder and platform operated by Sustainability Page ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms and you also agree to our Privacy Policy. If you disagree with any part of the terms, then you do not have permission to access the Service.

"You" refers to any individual or organization utilizing our Services. In the event that you use our Services on behalf of another individual or organization, you confirm and guarantee that you have the authority to accept the Agreement on behalf of that person or entity. By using our Services, you are acknowledging that you accept the Agreement on behalf of that person or entity, and in the event of a violation of the Agreement by you, that person or entity, both you and that person or entity agree to assume responsibility towards us.

The Terms of Service apply to all uses of the Website, regardless of whether you publish your “Page”.

a. To publish your “Page”, you must register as a user. Registration requires you to be 18 years of age or older. The collection and handling of your registration data and other information about you are governed by our Privacy Policy. If you are under 13 years of age, you are not permitted to use our products and services

b. As a registered user, you must provide accurate and complete registration information, and promptly update it if any changes occur. During registration, you will create an "Account" with a username and password. You are responsible for maintaining the confidentiality of your password and account and you are fully accountable for any activities that occur under your password or account.

c. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

d. Registering as a user grants you a Basic plan, which is entirely free and provides access to most of our core features.

e. Once registered, you made be able to upgrade to the Pro plan or the Premium plan for additional features that are not available in the Basic plan.

This Site uses SSL (Secure Sockets Layer) encryption technology based on server certificates to encrypt communications when User information is sent.

f. Payment processing for the upgraded plans are provided by Stripe and are subject to the (Stripe Connected Account Agreement), which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). You agree to be bound by the Stripe Services Agreement, as its contents may be modified by Stripe from time to time. As a condition of enabling payment processing services through Stripe, you agree to provide the Site with accurate and complete information about you and your business, and you authorize the Site to share this information and transaction information related to Stripe for processing payments.

g. You have the option to upgrade or downgrade from a Pro or a Premium plan. If you choose to upgrade to a higher-cost plan, you may be required to pay the price difference. On the other hand, if you decide to downgrade to a lower-cost plan, credit corresponding to the remaining time on your current plan will be added to your account balance. Upon request, we may, at our sole discretion, provide a full or partial refund of this credit to the original payment method used.

h. You have the option to cancel the Pro or Premium plan within the first 14 days. In the event of a cancellation, you will receive a full refund. In the event of a cancellation after 14 days, you will receive partial refund.

i. We reserve the right to modify or discontinue, temporarily or permanently, the Site (or any part thereof) with or without notice. You agree that we will not be held liable to you or any third party for any modifications, suspensions, or discontinuations of the Site.

a. The Service and its original content, features, and functionality are and will remain the exclusive property of Sustainability Page and its licensors. The Service is protected by copyright, trademark, and other laws of both the Japan and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Sustainability Page.

b. You recognize and agree that the Website may contain content or features that are protected by copyright, patent, trademark, trade secret, or other intellectual property rights and laws. Unless expressly authorized by us, you agree not to modify, copy, use, sell the works based on the Website or its content, in whole or in part. This restriction does not apply to your own content that you lawfully upload to the Website.

c. In using the Website, you will not engage in or utilize any data gathering or extraction methods.

d. We will not be liable in any way for any content or materials provided by users or third parties, including but not limited to any errors or omissions in such content, or for any loss or damage of any kind incurred as a result of using such content.

e. Sustainability Page and its representatives have the right (but not the obligation) in their sole discretion to refuse or remove any content available via the Website, including content that violates these Terms of service.

f. You agree and assume all risks associated with the use of any content, including reliance on its accuracy, completeness, or usefulness.

a. Our Service may contain links to third-party websites or services that are not owned or controlled by Sustainability Page. Sustainability Page has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.

b. You further acknowledge and agree that Sustainability Page shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

a. We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

b. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

a. You agree to defend, indemnify and hold harmless Sustainability Page and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; or b) a breach of these Terms.

a. In no event shall Sustainability Page, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conductor content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

a. Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

b. Sustainability Page, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

a. These Terms shall be governed and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.

a. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

b. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
